What the three-class system actually defines
Most US states use a three-class framework, and it defines an e-bike by how the assist behaves, not by how the machine looks.
- Class 1— pedal assist only, motor cuts out at 20 mph. No throttle.
- Class 2— throttle permitted, assist and throttle both cut out at 20 mph.
- Class 3— pedal assist to 28 mph, no throttle above 20 mph.
Alongside the class, most states cap motor power for something to count as an e-bike at all — commonly 750 W. A machine above that cap, or one that assists past 28 mph, is generally not an e-bike in the eyes of the law regardless of what the listing calls it. It falls into moped, motorcycle or off-road vehicle territory, with the licensing, registration, insurance and helmet rules that follow.

What an e-moto actually is
The machines driving this conversation share a recognizable set of traits. They are built on dirt-bike-derived frames with long-travel suspension, moto-style seats and no rear rack mounts. They carry motors well beyond 750 W rated — often quoted in the thousands of peak watts — and top speeds of 40 mph and up. The pedals, where they exist, are short, oddly placed and functionally useless for propelling the machine; they are there so the vehicle can be described as a bicycle.
That last point is the whole issue. A vehicle that is mechanically a light electric motorcycle, sold with vestigial pedals so it can be marketed as a bicycle, is being ridden on infrastructure designed for people traveling at 12–20 mph. Land managers respond to that the only way they can: with stricter rules, more signage and more enforcement.
Why this affects you even if you would never buy one
Three consequences, all of them landing on ordinary riders.
Path access is tightening.Trails and greenways that previously allowed all e-bikes are increasingly restricting to Class 1 and Class 2 only, adding speed limits, or requiring visible class labeling. A Class 3 bike that was fine on your local trail last year may not be this year — worth checking before you buy one.
Enforcement is by appearance first.Nobody at a trailhead is reading your controller’s current limit. A machine that looks like a small motorcycle gets stopped; a bike that looks like a bike does not. That is crude, and it is the practical reality.
Listings are getting vaguer.The pressure to stay marketable has pushed some sellers toward quoting peak watts only, omitting class entirely, or describing a machine as “up to 35 mph” without saying whether that is assisted or pedaled. Vague specs are a signal, not an oversight.
How to tell what you are looking at
Four checks, in order of how quickly they settle it.
- Does the listing state a class?A compliant e-bike from a serious brand says Class 1, 2 or 3, or gives a top assisted speed of 20 or 28 mph. Silence on class is the single strongest tell.
- What is the rated wattage?Not peak — rated. If a listing quotes only a peak figure in the thousands, ask for the rated one. Above 750 W rated, check your state’s cap before assuming it is an e-bike.
- What is the top speed?Anything over 28 mph assisted is outside the three-class system everywhere it applies.
- Can you actually pedal it usefully?If the pedals are cosmetic — too short to turn comfortably, geared so that pedaling contributes nothing above walking pace — the manufacturer has told you what the machine is.
The honest case for each
This is not an argument that fast electric two-wheelers should not exist. They are genuinely useful and often good fun, and for some trips they are the right tool.
The argument is that they belong in the vehicle category that matches what they do. A machine capable of 40 mph on roads should be registered, insured, ridden with a license and proper protective gear, and kept off shared-use paths — the same expectations we apply to a 50cc scooter. What an e-bike buys, by staying inside the class limits, is the thing that makes it valuable in the first place: no license, no registration, no insurance requirement in most states, access to bike lanes and most paths, parking at a bike rack, and a purchase that never generates a DMV visit. Push past the limits and you lose all of it at once.
What to buy instead
If the appeal of an e-moto is the look and the sense of a substantial, capable machine, the fat-tire end of the value bracket gets you most of it legally. If the appeal is speed, a Class 3 bike gets you to 28 mph with no paperwork.

One caveat on the Class 3 route: it is exactly the class most likely to be excluded from a multi-use path. If your best car-free route is a trail, check its posted rules before choosing speed over access.
